PRIVACY NOTICE

This Privacy Notice observes the principles of legality, consent, information, quality, purpose, loyalty, proportionality and responsibility established in the Federal Law for the Protection of Personal Data in Possession of Private Parties (LFPDPPP) of the United Mexican States and the laws applicable to the United States of America and international treaties.

ACCEPTANCE

The personal data provided by any natural person, including but not limited to, subscribers, clients, suppliers and/or users when using the services/platform/electronic media of "Vivienda Compartida SAPI de CV" (CoVive) and/or providing any type of information, you, THE USER, expressly:

  • You agree to the terms contained in this Privacy Notice;
  • You agree that the information provided by you may be stored, used and generally processed for the purposes stated, including for marketing and promotional purposes.
  • You grant CoVive permission to obtain, compile, store, share, communicate, transmit and use such information in any manner or form, subject to the conditions set forth herein and applicable laws.

Consent is not required for the processing of personal data for the purpose of fulfilling obligations arising from a legal relationship between you and CoVive, or in other cases established by law.

PRIVACY

In compliance with the LFPDPPP we inform you of the terms and conditions of CoVive's Privacy Notice, and the safeguards involved.

CoVive, may obtain your Personal Data, which is information that identifies you or makes you identifiable. Some of these data may include your: name, address, telephone number, email address, payment details, invoicing details, (examples given by way of example but not limited to). By providing this data, the USER expresses his/her will, either by prior express consent, verbally, in writing, by electronic, optical or any other technology, or by unequivocal signs when using CoVive's systems, or any other electronic means provided by CoVive for the USER's use.

USE OF DATA

CoVive will use the USER's Personal Data to:

  • To identify you, locate you, communicate with you, contact you, send you information and/or merchandise, provide a service and/or merchandise, as well as its transmission to third parties by any means. The use of personal data will be related to the type of interaction you have with the Controller, whether commercial, civil, mercantile or of any other nature.
  • To fulfil those obligations arising from the legal relationship between you as the owner of the personal data and CoVive,
  • Provision of services and solutions to the USER/CUSTOMER,
  • To assist with marketing and communication initiatives,
  • Any other after-sales service that CoVive offers to its customers, for the purposes of identification, promotion, sales, advertising, statistics, internal analysis, customer and consumer service.
  • Obtain information for statistical, advertising, promotional and/or marketing purposes;
  • Invitations to upcoming events, offers and promotions.
  • Have a point of contact regarding changes to the Terms and Conditions and Privacy Notice.
  • Surveys to improve user experience.
  • To ensure that you comply with the Terms and Conditions and applicable law.

CoVive, will keep your Personal Data only for the time provided by the LFPDPPP.

For certain services such as our advertising programs and/or purchase or subscription services, we also request credit card or other banking information, which we store in encrypted form on our secure servers. We may combine the information you provide to us through your account with information from other CoVive services or third parties in order to provide you with an optimal experience and to improve the quality of our services. For certain services, we will offer you the opportunity to decide whether or not you would like us to combine such data.

In the event that your personal data is intended to be used for a purpose other than the above, CoVive will notify you by email or electronic means, in order to obtain your consent to the processing of your personal data in accordance with the new purposes. If we do not receive your consent, for the cases where it is necessary, CoVive will not use your personal data.

CoVive will not sell, assign, distribute or disclose your communications to any third party without your consent, notwithstanding that disclosure of such communication may be required by applicable law.

Once the personal data is no longer required for the purposes for which it was collected, it will be deleted from our database.

DATA COLLECTION

When you visit any of the CoVive websites, we automatically collect some personal information, which we then aggregate so that it is not associated with a single identifiable individual. We use this information to compile statistics about how many users visited our websites and which pages they accessed. By collecting this information, we learn how to best tailor our websites to our visitors. As explained below, we collect this information through "log files" or "web beacons".

Log files: Log files are web server files (such as domain name or IP address, URL, http response code, the website from which you visited us or the date and duration of your visit) that are automatically created when an Internet user visits a site. Once you stop using our website, we will process and use this information only to allow further connections, for billing purposes, to detect disruptions in telecommunications equipment, as well as to detect abuse of our telecommunications services. This information is deleted immediately upon termination of your connection to the website.

This information is used to create general aggregate profiles of our site user base, and not to create personalised user profiles.

Web Beacons: Some pages on our website contain "web beacons" (also known as Internet tags, pixel tags and clear GIFs). Web beacons allow third parties to obtain information such as the IP address of the computer that downloaded the page on which the beacon appears, the URL of the page on which the beacon appears, the time of the visit to the page with the beacon, the type of browser used to visit the page, as well as cookie information sent by the third party.

The duration of the handling of personal data will be indefinite from the date on which you provided them to CoVive.

USER'S "ARC" RIGHTS

The exercise of "ARCO" rights (access, rectification, cancellation or opposition) may be exercised by THE USER at any time by following the procedures established in this Privacy Notice, including the information requested herein.

The USER may, at any time, revoke the consent that he/she has given and that is necessary for the processing of his/her personal data.

For ease of reference, "ARCO" rights mean:

  • To be informed which of your personal data are contained in CoVive's databases and what these personal data are used for.
  • Rectification: To have your personal data corrected or updated if it is inaccurate or incomplete. You shall inform CoVive of any changes that need to be made to your personal data, where such changes are only known to you.
  • Cancellation: That your personal data be removed in whole or in part from the databases of CoVive and third parties to whom CoVive has transferred Personal Data. This request will give rise to a blocking period after which the data will be deleted.
  • Opposition: To object for legitimate reasons to the processing of your personal data by CoVive or to limit their use or disclosure.

INVIOLABILITY MEASURES

CoVive has adopted physical, electronic, administrative and technical security measures to protect your personal data against damage, loss, alteration, destruction or unauthorised use, access or processing.

Only CoVive staff will have access to the Personal Data and such use will be limited to the purpose of carrying out the identified purposes. Likewise, the staff will keep the utmost confidentiality with respect to them and this obligation will subsist after the end of the USER/ COMPANY relationship.

In the event that at the time of providing your Personal Data to CoVive, you are assigned a user name and password or some kind of access code to access the information, the USER will be the only responsible for keeping this information confidential. It is suggested not to share this information with anyone.

TRANSFER OF PERSONAL DATA

CoVive refrains from sharing, without your prior consent, your Personal Data with third parties, unless required to do so by law or court order; or to protect the rights or property of CoVive or its customers; or such transfer is provided for by applicable law. Personal Data will only be used for the purposes mentioned in the Privacy Notice.

CoVive may transfer the data to national and international natural or legal persons for advertising and marketing purposes. By using this service/platform/programme/etc. THE USER expresses his/her full consent.

AMENDMENTS TO THE PRIVACY NOTICE

CoVive reserves the right to modify or amend, in whole or in part, this Privacy Notice. The amended Privacy Notice will be sent to the USER via the email address provided by the USER, by publication on the CoVive website or by any other electronic means that CoVive deems appropriate. Failure to object to the new Privacy Notice within 5 working days of its receipt will be understood as your acceptance of the terms set out therein.

In accordance with the LFPDPPP, any exercise of ARCO rights must be sent to the contact person established above, and must contain the following information:

  1. The name of the holder and address or other means of communicating the response to the request;
  2. Documents proving the identity or, where applicable, the legal representation of the holder;

III. The clear and precise description of the personal data in respect of which the exercise of any of the ARCO rights is sought, and

  1. Any other element or document that facilitates the location of personal data.

The holder must indicate, in addition to the above, the modifications to be made and provide the documentation supporting his request.

In accordance with article 30 of the LFPDPPP, CoVive has a person responsible for the attention that the USER deserves.
